Please note that by agreeing to use the DigiSafe Service, you are confirming that you have reviewed our Terms & Conditions and agree to be bound by them.
Customers Warranty
By availing of the DigiSafe Service, the Customer warrants that it owns the copyright of the goods in their entirety and/or has obtained the necessary licence to procure and manufacture the sale of the goods.
The Customer further warrants that any such redistribution and manufacture of the goods does not infringe the rights of any such third parties. It is unilaterally agreed that DigiSafe shall not be held liable, financially or otherwise for any claims pertaining to the copyrighted work by any third party. In the event of any action being taken against DigiSafe as a result of works completed at the Customers request, the Customer warrants that it will indemnity DigiSafe entirely, against any costs or steps taken in relation to said claim.
It is further warranted by the Customer that the content of the material supplied to DigiSafe is free from any obscenities, and does not contain any material which would be found to be objectionable, illicit, illegal, or criminal in nature.
The Customer agrees that in the event of any action being brought by any party as a consequence of the content of the material supplied by the Customer to DigiSafe, the Customer will irrevocably fully indemnify, and keep indemnified, DigiSafe against any costs incurred in such an Action.
Storage of the Materials
DigiSafe may retain a copy of the content of the material onsite for a period of 28 days from the date in which the material will be returned to the Customer. Thereafter the content of the material supplied will be destroyed/ deleted.
Privacy and Security
Any personal information provided to DigiSafe is provided with the knowledge that DigiSafe intends to take reasonable and appropriate steps to protect the personal information from unauthorised access and detection.
DigiSafe may keep personal information on file for future usage and may send the Customer updates about special offers, programs, new products and/or new services which DigiSafe believes the customer may be interested in. The user will be able to unsubscribe from the mailing list at any time after receiving the first information message. Alternatively, if the Customer does not want their information to be stored for such future use, the Customer shall inform DigiSafe in writing of this request.
DigiSafe does not intend to transfer personal information without your consent to third parties not acting on DigiSafe’s behalf unless such transfer is legally required.
Delay
DigiSafe approximates that each order shall be processed within 10 working days, however, in the event of any delay incurred in the completion of the order, DigiSafe shall not be liable for any claim in relation to same, and can extend the time for delivery without prior notification to the customer, provided same is reasonable in all the circumstances.
Sending and Return of Materials
DigiSafe reserves the right to use the services of third parties for the purposes of collection and delivery of materials. Any such third parties so involved are independent persons and are not Agents acting on behalf of DigiSafe.
DigiSafe does not assume responsibility nor accept liability for any loss occasioned or damage suffered to the materials from the collection/delivery process by the said third parties.
Any disputes in relation to loss of or damage to the materials during transit should be taken up directly with the third party so involved.
Sub-contracting to Third Parties
DigiSafe reserves the right to sub-contract out works to third parties, at their discretion. DigiSafe confirms that should any such works be sub-contracted to a third party, the Terms and Conditions herein stated shall apply with full effect.
Disclaimer for Loss or Damage to Customer Goods
DigiSafe will take reasonable care, in all the circumstances, to ensure that the materials provided are returned to the Customer in the same condition as they were received in.
DigiSafe, however, does not assume responsibility for the materials provided to them and any materials given to DigiSafe for the purpose of availing of their Service are provided at the owners risk and no responsibility, financial or otherwise is accepted by DigiSafe for any loss or damage thereto. In the event that any materials provided have been lost, damaged and/or destroyed by DigiSafe, DigiSafe accepts no liability for any consequential or indirect loss suffered by the Customer, whatsoever and howsoever caused.
Cancellation Policy
In the event that the Customer wishes to cancel their order, same can be done within 48 hours of the order having been made, provided always that no work has been commenced on the material provided and no transport or related costs have been incurred by DigiSafe or any other third party.
If any work has been commenced on behalf of the Customer before the cancellation is made, to include any transport or related costs, the Customer shall be liable for same, without exception.
General Use Provisions
All materials provided on this website, including but not limited to information, logos, images, graphics and services ("Materials") are provided by DigiSafe or by their third party providers are the copyrighted work of DigiSafe and/or its third party providers. Except as stated, none of the materials may be copied, reproduced, distributed, republished or transmitted in any form or by any means without the express written permission of DigiSafe.

This website may contain links to third party sites controlled by parties other than DigiSafe. DigiSafe is not responsible for and does not accept any responsibility for the contents or use of these third party sites. It is your responsibility to take precautions to ensure that whatever is selected for use is free of viruses or other items of a destructive nature.

Limitation of Liability
DigiSafe shall not be liable for any damages whatsoever and howsoever caused and suffered as a result of using the materials and/or information on the website.
DigiSafe shall not be liable for any damage whatsoever and howsoever suffered by the Customer nor any other individual as a result of using the services of DigiSafe. In no event shall DigiSafe be liable for any indirect, special, punitive, incidental or consequential damage however it arises, whether in an Action of contract, negligence or other tortuous Action, even if DigiSafe has been previously advised of the possibility of such damage.
